1. Scope and provider
These Terms govern your use of the Gramba app and related services. The provider is Gramba, a sole proprietorship owned by Michael Habegger, Rietstrasse 25, 8634 Hombrechtikon, Switzerland (the provider, we). By using the app you accept these Terms.
2. The service
Gramba is a practice companion for Spanish grammar. Room owners define practice topics; exercises are generated with AI, reviewed by the room owner and published as 7-day practice weeks; members complete short daily sessions. Gramba is a supplement to — not a replacement for — language teaching, and does not award certificates or officially recognised qualifications.
AI-generated content
Exercise content is generated by AI and reviewed by the room owner before publishing. Despite careful automated validation and human review, occasional errors can occur. Corrections are welcome at support@gramba.app.
3. Account and age
An account is required. If you are under 16, you may use Gramba only with the consent of a parent or guardian, or within a school context where such consent has been obtained. You are responsible for keeping your credentials confidential and for the accuracy of the information you provide.
4. Rooms and your content
Room owners are responsible for the content they enter or photograph (topic briefs, lesson photos) and for the exercises they publish to their room. Do not upload content you have no right to use, and do not upload content that is unlawful or inappropriate for the members of your room. Your content remains yours; you grant us the licence needed to operate the service (storage, processing for generation, display to room members).
5. Acceptable use
We grant you a non-exclusive, non-transferable right to use the app for your own learning or teaching. You may not misuse the service, reverse engineer it, disrupt it, circumvent its security or quota mechanisms, or use it for automated mass generation. We may suspend accounts that abuse the service.
6. Free and paid plans
Gramba offers a free plan and optional paid subscriptions (Pro, Classroom, School). Subscriptions purchased in the app are processed through the Apple App Store or Google Play, whose terms also apply, in particular regarding billing, renewal and cancellation. Prices are shown before purchase. School licences may be billed by invoice under a separate agreement.
7. Right of withdrawal (EEA consumers)
Consumers in the EEA generally have a 14-day right of withdrawal for paid digital content. The right lapses once performance begins, provided you have expressly consented and acknowledged that you thereby lose your right of withdrawal. Processing and refunds are handled by the respective app store.
8. Availability
Features may evolve, change or be discontinued over time; we will inform you of material changes in an appropriate manner. We strive for high availability but do not guarantee uninterrupted service.
9. Warranty and liability
The app is provided with reasonable care. To the extent permitted by law, our liability is limited to intent and gross negligence; liability for indirect damage and lost profit is excluded. Mandatory statutory liability (in particular for personal injury and mandatory consumer rights) remains unaffected.
10. Intellectual property
All rights in the app, its design and trademarks belong to us or our licensors. Content you provide remains yours (see section 4).
11. Termination
You may delete your account at any time in the app. We may suspend or terminate use in the event of material breaches of these Terms.
12. App stores (Apple / Google)
If you obtain the app through the Apple App Store, Apple’s standard licensed application end user licence agreement (EULA) also applies. Apple is not a party to these Terms and provides no support or warranty for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you obtain the app through Google Play, the Google Play Terms of Service also apply; Google is not a party to these Terms and provides no support or warranty for the app.
13. Changes
We may amend these Terms. We will notify you of material changes in an appropriate manner; continued use constitutes acceptance.
14. Governing law and jurisdiction
Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent permitted, the provider’s registered seat. Mandatory consumer protection provisions of your country of residence remain unaffected.
